401(k) Retirement Plan

Shake Shack offers a 401(k) Retirement Plan through Fidelity, which allows you to defer a percentage of your compensation on a pretax or Roth basis to save for retirement.

Eligibility

All Team Members who are at least age 21 are eligible for the 401(k) Retirement Plan. Team Members can enroll in the 401(k) on the 60th day of employment, and contributions begin on the 90th day.

Contributions

There are two ways you can contribute to the 401(k) plan, and you can change your contribution at any time:

  • Traditional – Contributions are taken pretax, which means they are not taxable to you until they are withdrawn from the plan.
  • Roth – Contributions are taken post-tax, which means the withdrawals in retirement are tax-free.

Company Match

Shake Shack provides a 401(k) employer match of up to 4% of your salary after you complete 12 months of continuous employment. This match is calculated and funded on a per-pay-period basis. To get the full employer match, you must contribute at least 6% of your salary as follows:

Note on Company Match

Note: Highly Compensated Employees (HCEs), as defined by the IRS, are not eligible for a company match. HCE thresholds are determined by the IRS and may change over time based on cost-of-living adjustments.

For more information, see the IRS Cost-of-Living Adjustments.

Vesting

You are always 100% vested in your own contributions. The percentage you are vested in Shake Shack’s contributions to your account is based on years of service:

IRS 2026 Contribution Limits
  • For 2026, the most you can contribute to a Roth or Traditional 401(k) (or a combination of the two) is $24,500*.
  • If you are age 50 or older, you may defer an additional $8,000* in 2026 (known as Catch-Up Contributions) for a total maximum of $32,500.
  • If you are ages 60-63 in 2026, you can maximize your contributions with the Super Catch-Up, which allows you to defer an additional $11,250* for a total maximum of $35,750*.

*Internal Revenue Service contribution maximums are subject to change.

Please ensure you do not exceed the IRS contribution limits for the year, especially if you’ve contributed to other 401(k) plans with previous employers. You are responsible for monitoring your contributions across all employers to ensure they remain within the maximum allowed.
